COMPLETELY LIED, BREACHED CONTRACT AND STOLE OUR MONEY

We were moving from St. Louis, MO to Golden, CO due to medical issues - I was referred to specialists in the Colorado area, so my husband got a job at the Boulder County Sheriff's Office to start work on 8/9/10. We were moving from an apartment that we were only 4 months into a 12 month lease, but due to the medical need for the move, the landlord graciously agreed to let us out of the lease early. I hired World Moving Services not because they gave me the best quote (I actually got a quote from another company for about $400 less), but because they promised an immediate pickup (the contract said items would be picked up 8/4/10-8/5/10 or sooner, but every day I talked with them I was told it would be picked up tomorrow). We had to leave for Colorado to sign the lease at our new apartment, plus the need to vacate the old apartment as the landlord was letting us out of our lease, which is why it was so crucial for the items to be picked up on 8/1/10 as originally promised to get me to sign a contract. We left everything packed and organized and ready to go. We did pack items such as clothing into bags, as we have done when using other moving companies because it's sometimes easier than handling all boxes. And, we left a small amount of clothing in drawers, as other moving companies have actually asked us to do because it doesn't add any significant weight to the dresser and that makes less boxes for them to have to carry. We were not told neither of these things could be done. When we were told the items would not be picked up until 8/9/10 or 8/10/10, needless to say I was not pleased, and made it known to customer service. That's when someone from what I am guessing is a complaint department called to rectify the discrepency of the items not being picked up by the deadline on the contract. I was offered $200 refund to keep the contract with them active and not go to another company (which I had another company telling me they could pick up our things the very next day for $1,200). Since the World Moving Services already had $585.94 of our money from the original deposit, I thought it would be easier to stay with them rather than trying to get the deposit back (which we didn't have the money to give another company a deposit without getting the deposit from World Moving Services back first), and they were acting like they would work with us by giving us a $200 refund and ASSURRED us the items WOULD be picked up 8/9/10 or 8/10/10. The items were picked up on 8/10/10, but, without our permission or consent, the driver took it upon himself to pack our bags into boxes, and removed the little bit of clothing left in drawers and packed them into boxes as well. Apparently, it was against his company's policy to take bags, which is when we found out World Moving Services sub-contracted our contract to another company since they themselves were unable to get our things. By the time the driver got to Colorado with our things, he said he would not give us our things until we gave him $2,279.91 (he charged $1,000 for packing, and the extra boxes made the weight more than estimated). I called World Moving Services and they tried to say that was the fee agreed to in our original contract. My husband got on the phone and explained he had the contract in front of him, which stated very clearly the total charge would be $1,485.52, minus the deposit of $585.94 we gave them, which left a balance due of $899.58 (plus they had already promised to take $200 from the original deposit, which would have brought the total end charge to $1,285.52). They put me on hold while they spoke with the company they had sub-contracted us out to. They said there was nothing that could be done about it right away and, unless we wanted the driver to take our things to a storage facility and start charging per day for them to store it, we should pay him the $2,279.91 to get our things and they would work on getting it resolved afterwards. Not only are they not working on getting it resolved, but they haven't even given us the original $200 refund they promised to stay with them. They e-mailed a form they want me to sign and fax back before they will give us the $200, which releases them from any and all liability, and takes away any rights we have to ever file a complaint/suit against them. I'm not sure exactly what our options are, if we even have any (I'm guessing this will end up being a very expensive lesson). I did file a complaint with the BBB, just asking for a refund for the difference to make the ending total paid the original $1,285.52 promised. If anyone knows if we have a legal leg to stand on, I would take any/all advise given (I still haven't signed the form they want me to in order to get the $200, which would take away all rights to do anything).
