Would not refund the deposit despite not doing the move

America's Moving Services is a very professional Company with very knowledgeable representatives.
The movers arrived at our Houston apartment on time and acted very courteously.
The quote given for the move was reasonable compared with other moving companies.
My dealings with Jerimiah and others at the company prior to move day were very pleasant.
When the movers arrived they noticed the presence of roaches in the apartment and eventually refused to move any of the boxes or furniture. There is a well known roach problem in almost every apartment in University Housing Health Sciences complex at UT Houston which has been brought to the attention of Housing Management on numerous occasions by the tenants.
Whilst it was the right of America's Moving Services not to do the move, there is no mention after careful reading of the contract we signed, of a move not being done for these reasons.
I completely understand America's Moving Services position on this matter, and sympathize but not only were they out of pocket because of empty space on their truck but we were also out of pocket many thousands of dollars due to moving having to take place that day due to work commitments at our destination.
In light of their being no reference in our contract to America's Moving Services unilaterally cancelling the contract for the reasons mentioned above and keeping the $500 deposit, and University Housing Management being responsible for state of the apartments, we would amicably request a settlement with America's Moving Services of a refund of our deposit.
Should the occasion arise in future, I would not hesitate to entrust my next move with America's Moving Services despite the present experience.
