I entered into a contract with Home Team Movers on 9/27/13. This contract was supplied by Steve, via an email titled "Moving Estimate" and offered the reference #5718639 with a Total Estimate of $1871.89. The contents of the email offered verification that this was a Binding Estimate (it was labeled as such and even presented a charge of $295 for the service of supplying a Binding Estimate). The Binding Estimate further offered an itemized explanation of charges, totaling 94 pieces.
When the movers, Smart Moving Inc, arrived on 10/1/13, the contract suddenly changed. I was no longer being presented with a Home Team Movers contract, but rather a RELO VAN LINES, LLC Interstate Bill of Lading Contract and Order for Service, and the estimated charges were suddenly projected at $2871.10. Although the movers were from Smart Moving, Inc. I am uncertain as to what changed?
The movers, Smart Moving Inc., configured the new estimate with no means of careful calculation in mind. There is no clear estimate of our inventory, when the truck showed up to our house it was by any means not empty. The truck was already crammed with other mover's materials and inventory. Their calculation for the second estimate was to view the inventory and then view the space that was left in the truck. As clearly as anyone can see there is no precise calculation here, therefore the estimate that was provided to us is not accurate by any stretch of the imagination. Again, back to my stated issue of how the new estimate was calculated. When I questioned the change in price I was told that the company's computer always miscalculates and never estimates correctly. This was not information that should have been shared to me and at that point my lack of satisfaction for the company immediately diminished.
My boxes were loaded into the truck prior to the second contract being signed, which bound the company to the original estimate. The company told us that they would not ship our stuff without this signed and payment.After disputing the second estimate, which as stated above was not carefully calculated, we had no choice, but to proceed forward due to moving deadlines.
Through a course of 2 weeks I had reached the driver, Roman many times. Our conversations were short considering that Roman spoke little English and I couldn't understand because the language barrier.
The dispatcher at his office told me that Roman had to be off the road for a certain amount of hours because of the DOT California Regulations.
On 10/16 at 5:00pm, while at work, I got an unexpected call from the driver, Roman. He curtly told me "he was at his last delivery and he would be at my house in 1 hour. If I wasn't there in 1 hour he would return tomorrow morning."
I hurried home and met Roman there, from this point Roman and I had many conversations. Through these conversations he was rude, unprofessional, and harassing. He used his size to his intimidation of me since I am female. He demanded money that was not on the contract and told me that he would not give me myself until he was fully paid.
Smart Moving, Inc, failed to relinquish possession of my shipment. The carrier sat in my driveway. The gentleman was threatening and intimidating, using his bulk and implied aggression to force a result. I was disrespected and blatantly yelled at. I was placed in a position in which I feared physical rebuttal.
I had to pay additional money to the driver, Roman, which was not explained to me or written in the contract.
Not only did I have to pay more money to receive my shipment, but numerous materials and objects of mine were damaged. All of my boxes had water damage to them. My television was broken and my rims for the vehicle were gouged. Along with the damaged contents of the shipment,the movers took no appreciation in my current home and scratched/gouged the refurnished wood floors.
I have tried to contact the owner on numerous occasions, but he refuses my attempts of communication. You cannot email the business either, but their email address are inactive.
